PRC-Saltillo’s Empower® software for Accent® 800, 1000, and 1400 devices is easy to use and learn and can be customized specifically for the communicator’s needs. The simple interface helps the user start communicating quickly. Empower software provides the power to initiate conversation, seek information, state opinions, and share feelings.

Current Software Version

This user manual always reflects the current software version. If you are not running the current version, the Empower software may not include all the features outlined in the manual.

It is helpful to know the version of the software you are using, especially when communicating with technical support staff. To find your software version number, go to Menu > Toolbox > System Settings. See the “Current Version” displayed on the Updates tile.

Safety Guidelines

Device Safety

Emergencies

  • This device is not intended to be an emergency call device or sole communication aid.

Modifications

  • Do not attempt to modify the device, module, or any accessories. Modifications could create a safety hazard and make the equipment inoperative.

Contaminants

  • To prevent ingestion of bacteria, dust, and dirt, do not allow the user to chew on the product.

Cleaning, Maintaining, and Servicing

  • Do not service or maintain the device while in use. Disconnect the charger and turn off the device before cleaning.

  • If the device, module, or an accessory is damaged, call Service for assistance. Do not attempt to make repairs yourself.

Accessories

  • Do not use accessories, detachable parts, or materials not described in the manual.

  • Do not use accessories, detachable parts, or materials in any other way than described in the manual.

Mounting and Positioning

  • A qualified person should analyze positioning to prevent repetitive stress injuries to the user.

  • A qualified person should install and adjust any mounts, including switch mounts. Failure to install the mounting system according to the manufacturer's instructions may result in an injury to the user.

  • Do not place the device with an eye tracking or head tracking module attached where it is difficult to operate or difficult to disconnect from the charger.

Vision and Hearing

  • The communication partner should ensure that the user takes frequent breaks to avoid eye strain.

  • Consult your vision care provider about device positioning considerations for the user.

  • Excessive volume or sound pressure level when using earphones or headphones can cause hearing loss over extended periods of time. Set the volume to a low level and increase it only enough that you can hear comfortably.

Ports and Connectors

  • Keep ports and connectors clean to maximize the service life of the device. Dirty cable connectors transfer contamination to the mating connector on the device and may degrade performance.

  • If the device has been exposed to water, each USB port must be completely dry before a USB cable is inserted into it. To remove moisture from the USB ports, shake the device several times with each USB port facing downward, and then use a microfiber cloth to wipe the device dry. You should then check the USB port area again. If moisture is still visible in any USB port, repeat the shaking and drying procedure.

  • Do not try to force a connector into a port. Be sure to insert the connector into the correct port and that the connector is turned so that it matches the orientation of the port.

Small Parts, Cords, Cables, and Straps

  • Cords, cables, and straps are potential entanglement or strangulation hazards. Consider this prior to placing these items with device users.

  • On a regular basis, visually inspect cables, cords, and connectors for damage or wear, especially where they are subject to extra stress. Cables and cords can become frayed or damaged from heavy use or with age. For example, a frayed cable could cause a battery charger/power adapter to short-circuit, posing a hazard to the user. If any cable, cord, or connector is damaged or worn, call Service for a replacement.

  • When unplugging a cable or cord, grasp the connector instead of the cable or cord itself to avoid damage or wear.

  • Always use cables, for charging or transferring vocabulary files, according to the instructions in the manual.

  • If the stand is removed, it becomes a potential hazard for poking an eye. Closing the stand could pinch a finger.

  • The stylus is a potential hazard for poking an eye.

  • If you are installing a head tracking or eye tracking module, the loose screws can be a choking hazard.

  • Small parts and loose adapters can present a choking or other hazard.

Damage

  • Do not use the device if the screen is cracked or broken.

  • Do not use an eye tracking or head tracking module if the lens is cracked or broken.

Interference

  • When operating this device in a medical environment, do not use it with any product that is not medically approved. Follow all rules for appropriate wireless device use.

  • Do not use the device or module close to sources of RF/RFID radiation or you may encounter interference. Move away, if possible, from the source of the interference.

Water

  • If the device has been exposed to water, each USB port must be completely dry before a USB cable is inserted into it. To remove moisture from the USB ports, shake the device several times with each USB port facing downward, and then use a microfiber cloth to wipe the device dry. You should then check the USB port area again. If moisture is still visible in any USB port, repeat the shaking and drying procedure.

  • The device is intended for use in normal communication situations. It is not waterproof. Do not spray or splash liquid directly on the device and use extreme caution when using it around water. As with most electronic devices, you should never use the device when you are actually in the water (for example, a pool or bath).

Heat

  • Do not place the device or module in an appliance such as a microwave or oven, near an open flame, or on or near a source of heat such as a stove or heater.

  • Do not leave the device or module in a hot vehicle for a prolonged period.

Batteries and Charging

  • Use only the battery charger provided with this device.

  • Do not place the device where it is difficult to operate or difficult to disconnect from the charger.

  • Always follow the instructions in this manual when charging the device.

  • Do not insert any object into the charging port. This can result in damage to the port.

  • To avoid electric shock and damage to the device, do not charge the device while it is wet or in an area where it could get wet. Do not handle the device, charger, or cords with wet hands.

  • Locate the device in a safe, dry location while charging. Do not charge the device outdoors.

  • Keep the charger away from water and do not allow water or any other liquid to spill on it.

  • If the charger or charger cord is damaged, call Service for a replacement.

Environment

  • Do not take the device into an oxygen-rich environment (operating room, oxygen tent, etc.).

  • Do not use the system in an environment in which explosive or flammable gases could be present.

Touching the Surface

  • While the device is charging, touching the surface of the device with broken skin may aggravate a wound.

  • While the device is charging, high-risk groups should not touch the surface if there is a chance of burning the skin.

Implantable Medical Devices

A minimum of 6 inches should be maintained between a handheld wireless device and an implantable medical device, such as a pacemaker, implantable cardioverter defibrillator, vagus nerve stimulator, shunt, or stent, to avoid potential magnetic interference with the medical device. A person who has an implantable medical device:

  • should always keep the device a minimum of 6 inches from their implantable medical device;

  • should not carry the device in a breast pocket;

  • should move the device away from themselves if they suspect it is interfering with the implantable medical device;

  • should read and follow the directions from the manufacturer of the implantable medical device.

  • If you have any questions about using the wireless device with an implantable medical device, consult your health care provider.


Software/App Safety

  • The software is not intended to be an emergency call app or a sole communication aid.

  • Use the software safely while texting. Do not text while performing another task or activity.

  • The communication partner should ensure that the user takes frequent breaks to avoid eye strain.

  • Consult your vision care provider about positioning the device for the user to view the software.

  • When adjusting volume in the software, excessive volume or sound pressure level when using earphones or headphones can cause hearing loss over extended periods of time. Set the volume at a low level and increase it only enough that you can hear comfortably.

  • If the software stops functioning, contact the Service department.


Eye Tracking Safety

The following safety guidelines apply to devices with an attached eye tracking module purchased from PRC-Saltillo only.

Fatigue

  • While the user is getting used to eye tracking, take frequent breaks to rest the user’s eyes and relax his or her concentration.

  • Some people may experience a certain amount of fatigue (due to intentional eye focusing and hard concentration) or even a dryness of the eyes (due to less frequent blinking) when first getting used to eye tracking. If you are experiencing fatigue or dry eyes, start off slowly and limit the length of your eye tracking sessions to your comfort level. Moisturizing eye drops can be helpful to combat dryness.

Seizures

  • Some people may have epileptic seizures triggered by light flashes or patterns. This may occur while presented successive pictures or video material, even if they have never had a seizure before. Observe the individual using the system. Move the person away from the system immediately and consult a physician if the individual shows the following or similar symptoms: involuntary movements, disorientation, convulsions, loss of awareness, or altered vision.

Infrared Emissions

  • Eye tracking systems uses infrared (IR) technology. Certain medical devices are susceptible to disturbance by IR emissions. Do not use the eye tracking system when in the vicinity of such susceptible medical devices. If you have questions about the susceptibility of a medical device, consult the manufacturer of the medical device or your health care provider.

  • If you have questions about the susceptibility of a medical device to the infrared technology that is part of your eye tracking system, consult the manufacturer of the medical device or your health care provider.

Compliance Information

Device Compliance

Federal Communications Commission (FCC) Warning

This device complies with part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) This device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation.

Changes or modifications to this device not expressly approved by PRC-Saltillo could void the user’s authority to operate the equipment.

Note: This equipment has been tested and found to comply with the limits for a Class B digital device, pursuant to Part 15 of the FCC Rules. These limits are designed to provide reasonable protection against harmful interference in a residential installation. This equipment generates, uses and can radiate radio frequency energy and, if not installed and used in accordance with the instructions, may cause harmful interference to radiocommunications. However, there is no guarantee that interference will not occur in a particular installation. If this equipment does cause harmful interference to radio or television reception, which can be determined by turning the equipment off and on, the user is encouraged to try to correct the interference by one or more of the following measures:

  • Reorient or relocate the receiving antenna.

  • Increase the separation between the equipment and receiver.

  • Connect the equipment into an outlet on a circuit different from that to which the receiver is connected.

  • Consult the dealer or an experienced radio/TV technician for help.

Innovation, Science and Economic Development Canada (ISED) Warning

This device complies with Innovation, Science and Economic Development Canada license-exempt RSS standard(s). Operation is subject to the following two conditions: (1) This device may not cause interference, and (2) This device must accept any interference, including interference that may cause undesired operation of the device.

FCC RF Radiation Exposure and SAR Statements

This device has been tested for body-worn Specific Absorption Rate (SAR) compliance. The radio module has been evaluated under FCC Bulletin OET 65C (01-01) and found to be compliant to the requirements as set forth in CFR 47 Sections, 2.1093, and 15.247 (b) (4) addressing RF Exposure from radio frequency devices. This model meets the applicable government requirements for exposure to radio frequency waves. The SAR limit set by the FCC is 1.6 W/kg.

Wireless Communications Equipment

Wireless communications equipment such as wireless home network devices, mobile phones, cordless telephones and their base stations, and walkie-talkies can affect this device and should be kept a least six inches away from the device.

Limitation of Intended Use, Third Parties, and Data Loss

  • PRC-Saltillo does not warrant any functionality of this speech generating device outside the terms of its express warranty relating to the intended use of speech generation. PRC-Saltillo does not warrant any third-party software, nor is it responsible for any injury, damage or claims arising from the function or malfunction of any third-party technology, websites, products, and software. Additional uses may require further clinical determinations beyond the scope of an evaluation for speech generation devices.

  • PRC-Saltillo assumes no responsibility for any loss or claims by third parties which may arise through the use of this product.

  • PRC-Saltillo assumes no responsibility for any damage or loss caused by the deletion of data as a result of malfunction repairs or battery replacement. Be sure to back up all important data on other media (computer) to protect against its loss.

Device Intended Purpose

The device is a speech generating device that augments communication for an individual with speech/language impairment. This device and its language programs give the user the ability to initiate conversation, seek information, state opinions, and share feelings. Depending on the model, it can be hand-held, used with a table stand, or mounted to a wheelchair; and can be accessed by using the touchscreen, an available eye tracking system or head tracking system, or a variety of available switch accessories. The device does not incorporate in any way medicinal substances, human blood or plasma derivatives, nor is it manufactured using tissues of animal origin.

Indications and Contraindications

Indication: The device is a speech generating device that augments communication for an individual with speech/language impairment.

Contraindication: This device is not intended to be an emergency call device or sole communication aid.

Existing Application Risks

No existing application risks are known.

Expected Service Life

The expected service life of the device, battery charger, and accessories is five years. If you dispose of your device, battery charger, or accessories, please dispose of them in accordance with your local, state, and/or country electronic recycling laws.

Intended Operators

The individual using the device to communicate, the individual’s communication partner, and/or the person changing device settings, maintaining software files, etc., are the intended operators of the device. The pictures and text in the manual will help these operators achieve the intended use of the device.

Expected Position of Operators

In normal use, the device is expected to be within 12 to 14 inches of the individual’s body. The distance will vary according to whether the device is hand-held or mounted on a wheelchair or table.

Special Skills, Training, or Knowledge Required

No special skills or training are required to operate or maintain the device. The pictures and text in this document will help the operators acquire the knowledge to achieve the intended use of the device.

Instructions for Use

  • All functions of the device are safe for use by the user. For best results, follow the instructions in the manual.

  • There is no need to turn the device or amplifier off when using the device on a daily basis. It is recommended to restart the device once per week and put it to sleep daily.

  • To report any serious incident associated with the device, contact PRC-Saltillo and your national authority. For information on cleaning, see the user manual.

Instructions for Storage

If you will be leaving the device in storage for a long period of time, turn the device and amplifier off. Devices in storage must be charged every six months.


Software Compliance

Wireless Communications Equipment

End User License Agreement

This End User License Agreement (EULA) and all of the terms and conditions contained herein along with the PRC-Saltillo Privacy Policy (prc-saltillo.com/privacy-policy) and Terms of Use (prc-saltillo.com/terms-of-use) (“Agreement”) constitute a legal agreement between the person, company or organization (“you” or “user”) that has acquired PRC- Saltillo Software (“Software”) and the Prentke Romich Company, doing business as PRC-Saltillo® (“PRC-Saltillo”, “we,” “us” or “our”). This Agreement governs your use of Demonstration Software acquired through download for use on your computer and Language Software loaded on to a PRC-Saltillo speech-generating device (“Device”). PRC-Saltillo Demonstration Software may include ChatEditor™, NuVoice® PASS™, and Empower® Demo Software. PRC-Saltillo Language Software is distributed on PRC-Saltillo speech-generating devices including those within the Accent®, NovaChat®, and Via® lines of devices.

By obtaining and using or downloading the Software, you agree to be bound by this Agreement and all its terms and conditions.

If you do not agree to the terms of this Agreement, you should not install or use the Software. If you have already installed it, you should immediately uninstall the Software as you shall have no right to use it. If you purchased the Software as part of a speech generating device, promptly contact PRC-Saltillo for instructions on return of the unused Device for a refund. ANY USE OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO USE ON THE DEVICE, WILL CONSTITUTE YOUR AGREEMENT TO THIS EULA (OR RATIFICATION OF ANY PREVIOUS CONSENT).

PRC-Saltillo and its suppliers own all of the intellectual property in the Software available on its Devices and for download on other Devices. This license grants you permission to use it only in accordance with the terms of this Agreement.

Grant of Software License

This EULA grants you a limited, terminable, non-exclusive license to use the Software for the purposes described in the documentation related to the Software. This also governs any Software upgrades provided by PRC-Saltillo that replace and/or supplement the original version of the Software downloaded, unless such upgrades are accompanied by a separate license, in which case the terms of that license will govern.

You may:

  1. install PRC-Saltillo Demonstration Software on any Device that you own or control or use PRC-Saltillo Software on your PRC-Saltillo speech generating device;

  2. use the Software for personal, educational purposes only;

  3. make one copy of the Software for back-up, archival purposes, provided such copy contains all of the original proprietary notices provided with or otherwise relating to the Software.

You may not use, or permit others to use, the Software except under the terms expressly listed in the Agreement. A separate license must be obtained or purchased for each end user. Without limiting the generality of the foregoing, you shall not, and shall not permit anyone else to:

  1. use the Software on any Device that you do not own or control;

  2. use the Software for service bureau, time-sharing or other similar purposes;

  3. modify, translate, reverse engineer, decompile, attempt to derive the source code of, disassemble (except to the extent that this restriction is expressly prohibited by law), or create derivative works based upon the Software;

  4. copy the Software (except as permitted above), any updates or any part thereof;

  5. rent, lease, distribute, or otherwise transfer rights to the Software (unless so allowed elsewhere in this Agreement)

  6. develop, sell, or distribute other software or applications that integrate with the Software or otherwise make use of the Data;

  7. remove any proprietary notices or labels on or relating to the Software; or

  8. use the Software in any manner that could impair any website that we may own or operate currently or in the future, including but not limited to the PRC-Saltillo website located at prc-saltillo.com (“Website”) or in any way or interfere with any party’s use and enjoyment of the Website.

Without limiting the foregoing, the Software and all information or data downloaded by or in connection with it are protected by the copyright law of the United States and international copyright treaties, as well as other proprietary rights.

Transfer of Software License

Software transfer allowed only in connection with Software transferred with a PRC-Saltillo Device. You may permanently transfer rights under this EULA only as part of a permanent sale or transfer of a Device, and only if the recipient agrees to this EULA. If the Software is an upgrade, any transfer must also include all prior versions of Software.

All right, title, and interest in and to the Software (including without limitation all intellectual property rights) shall remain with us.

Use of Information

To facilitate product support, product development and improvement as well as other services to you, you agree that PRC-Saltillo or other third parties authorized by PRC-Saltillo may use cookies, web beacons and other analytic technologies to collect, use, store and transmit non-personally identifiable technical and related information regarding your Device, including unique telemetry I.D., device make and model, and operating system. In addition, such parties may collect, store, use and transmit non-personally identifiable software usage metrics, statistics, or analytics.

Termination

You acknowledge that we have the right to restrict access to, terminate and/or otherwise modify the Software for any reason, including but not limited to a breach of any provision of the Terms of Use on our Website or this Agreement. On termination, you must destroy all copies of the Software and any information or data downloaded from the Software to your Device.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, COMPATABILITY, SECURITY, ACCURACY OR NON-INFRINGEMENT. THIS SOFTWARE DOES NOT INTENTIONALLY INFRINGE ON ANY THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS AND PRC-SALTILLO DOES NOT WARRANT AGAINST NON-INFRINGEMENT.

Symbol Applications/Software

This EULA specifically covers PRC-Saltillo Software and future downloads of such Software. PRC-Saltillo Software contains symbols proprietary to PRC-Saltillo and symbols used under license from others. These symbols include Minspeak®, Pixon®, the Tobii Dynavox PCS® symbol library, the news2you SymbolStix® symbol library, and Metacom symbols. PRC-Saltillo owns or holds a license for all of the intellectual property in the Software. The use of any Software that contains or provides access to proprietary symbol sets or any part thereof, is governed by the following provisions in addition to the rest of the terms and conditions of this Agreement.

The symbols accessed through this Software may not be used to create materials in print or electronic form, whether for communication or instruction, except by a single user in conjunction with use of this Software. Distribution of any content or materials using symbols in other formats (e.g. .pdf or PDF, .ppt or PowerPoint, .doc or WORD, or similar software formats used to display and/or transmit text and/or images) is not permitted. Users of this Software may not rent, lease, or lend symbols, or provide them to any online service or commercial hosting services. Users may not sublicense, assign, or transfer any rights to the symbols, or authorize all or any portion of the symbols to which the user has access to be copied onto any computer or other device.

Minspeak® icons and Pixon® symbols are registered trademarks of PRC-Saltillo.

The Picture Communication Symbols (“PCS”) accessed with PRC-Saltillo Software may not be used to create materials in print or electronic form, whether for communication or instruction, except by a single user in conjunction with use of this Device. PCS symbols may be distributed solely in Boardmaker file formats designated with a ”.bm2”, “.zip”, or “.zbp” file extension. Distribution of any content or materials using PCS symbols in other formats (e.g. .pdf or PDF, .ppt or PowerPoint, .doc or WORD, or similar software formats used to display and/or transmit text and/or images) is not permitted.

SymbolStix symbols are used in PRC-Saltillo Software with permission under license from n2y, LLC. The Library of SymbolStix Character/Logo Symbols Contained in PRC-Saltillo software is included free of charge, may be used solely for communication purposes, and may not be sold, copied, or otherwise exploited for any type of profit. SymbolStix symbols may be distributed for personal use only when a SymbolStix Prime subscription is purchased.

USER, OR A PARTY WITH AUTHORITY TO BIND USER, UNDERSTANDS AND ACKNOWLEDGES THAT PRC-SALTILLO DOES NOT WARRANT ANY FUNCTIONALITY OF THIS SPEECH GENERATING DEVICE OUTSIDE THE TERMS OF ITS EXPRESS WARRANTY RELATING TO THE INTENDED USE OF SPEECH GENERATION. PRC-SALTILLO DOES NOT WARRANT ANY THIRD-PARTY SOFTWARE, NOR IS IT RESPONSIBLE FOR ANY INJURY, DAMAGE OR CLAIMS ARISING FROM THE FUNCTION OR MALFUNCTION OF ANY THIRD-PARTY TECHNOLOGY, WEBSITES, PRODUCTS, AND SOFTWARE. ADDITIONAL USES MAY REQUIRE FURTHER CLINICAL DETERMINATIONS BEYOND THE SCOPE OF AN EVALUATION FOR SPEECH GENERATION DEVICES.

Via Device Language Software

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPLE WILL HAVE NO WARRANTY OBLIGATION WHATSOEVER WITH RESPECT TO THE SOFTWARE, AND ANY CLAIMS, LOSSES, LIABILITIES, DAMAGES, COSTS OR EXPENSES ATTRIBUTABLE TO FAILURE TO CONFORM WITH A WARRANTY MADE UNDER THIS AGREEMENT (IF ANY), WILL BE PRC-SALTILLO’S SOLE RESPONSIBILITY.

Use of language software on the Via line of devices is also governed by the applicable license agreement for the particular iOS application.

Accent Device Language Software

PRC-Saltillo Accent Devices include software licensed by PRC-Saltillo from Microsoft Licensing Inc. or its affiliates (“MS”). Those installed software products of MS origin, as well as associated media, printed materials and “online” or electronic documentation (software) are protected by international intellectual property laws and treaties.

IF YOU HAVE RECEIVED ANY WARRANTIES REGARDING THE DEVICE OR SOFTWARE, THOSE WARRANTIES DO NOT ORIGINATE FROM, AND ARE NOT BINDING ON, MS. THE SOFTWARE IS NOT FAULT TOLERANT. PRC-SALTILLO HAS INDEPENDENTLY DETERMINED HOW TO USE THE SOFTWARE AND MS HAS RELIED UPON PRC-SALTILLO TO CONDUCT SUFFICIENT TESTING TO DETERMINE THAT THE SOFTWARE IS SUITABLE FOR SUCH USE.

Note on Java Support: The Software may contain support for programs written in Java. Java technology is not fault tolerant and is not designed, manufactured, or intended for use or resale as online control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of Java technology could lead directly to death, personal injury or severe physical or environmental damage. Sun Microsystems, Inc. has contractually obligated MS to make this disclaimer.

Export and Other Laws

You may not use the Software in contravention of any federal, state, or other applicable laws. Without limiting the foregoing, the Software may be subject to United States export control laws, and you agree to comply strictly with all such laws which are now or hereafter in effect. In particular, but without limitation, you may not export or re-export the Software: (a) into any United States embargoed countries or (b) to anyone on the United States Treasury Department’s list of Specially Designated Nationals or the United Sates Department of Commerce Denied Person’s List or Entity List. By using the Software, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of missiles, nuclear or chemical or biological weapons.

Indemnification

You agree to indemnify, hold harmless and, at our option, defend us and our affiliates, and our and their officers, directors, employees, stockholders, agents and representatives from any and all third party claims, liability, damages and/or costs (including, but not limited to, reasonable attorney’s fees and expenses) arising from your improper use of the software, your violation of this Agreement, or your infringement, or the infringement or use by any other user of your account, of any intellectual property or other right of any person or entity.

Translations, Governing Law and Choice of Forum

PRC-Saltillo may translate this Agreement into various languages. However, the English language version is the original and controlling Agreement, and all other language versions are translations for information purposes only. In the event of any conflict or inconsistency between any terms of this Agreement in English and in any translation, the English language version of this Agreement shall prevail. This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to your use of this Software or this Agreement shall be filed only in the state or federal courts located in or having jurisdiction over Wayne County in the State of Ohio and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

Waiver of Breach

Our waiver of a breach of any provision of this Agreement by any user shall not operate or be construed as a waiver of any subsequent breach by you or any other user.
